Challenge in this
Writ Petition was made by students of the Delhi University to the circular
dated 14.05.2020.
By way of the
circular dated 14.05.2020, the University declared that the examination of the
final year students shall be held through remote open book exams starting from
01.07.2020;
Pleas raised by the
petitioners:
They belong the
economically weaker sections and may not have adequate infrastructure. The circular
violates Right to Equality as exams when conducted in an Examination Hall
ensures the same environment and facilities for all the candidates. when exams
are held from homes, different students would have different atmosphere
background noise, sitting space, dedicated room etc. no possibility of keeping
a check on cheating by the students.
Plea of the
University:
Students are not
bound to appear in the remote open book examination and they can opt to appear
in the conventional examination which will be tentatively held in September,
2020.
While upholding the
notification, the Hon’ble High Court permitted the students who opt not to
appear in the Open Book Exam (“OPE”) to appear in the post graduate entrance
test of the university.
It is a welcome
direction for the students who may face difficulty in appearing for the OPE or
choose to appear when exams are held in the conventional manner.
We must also
appreciate the step by the University for finding ways to cope with the current
unprecedented situation.
The circular was
previously challenged by the National Federation of the
Blind vs. Union Of India & Ors, (2018) 11 DEL CK 0074 before a
Division Bench of the Delhi High Court wherein it was upheld by the Hon’ble
Court.
But Programme main
thoda change hai as the Delhi University has postponed the exams now till
August!
