issued notice to 13 States including the Centre & the State of Kerala in a
plea challenging the use of barbaric means to ward off wild animals.
The three-judge
bench of Chief Justice SA Bobde, Justices R. Subhash Reddy and A.S. Bopanna was
hearing a petition filed regarding an incident in Kerala, where, offered to her
allegedly by some locals. This was not an isolated incident as another Elephant
had died due to similar circumstances in Kerala, the plea said. The plea sought directions to
Centre and State governments to make necessary
amendments in the Prevention of Cruelty against Animals Act, 1960 to increase
the Punishment for Cruelty against Animals and to make it more stringent as per
modern times.
It has further been
submitted that “Failure to eliminate de jure (formal) and de facto
(substantive) abusive treatment meted out to Animals including by non-State
actors, either directly or indirectly, violates not only the most basic rights
of Animals but also violates their basic dignity as a living being as envisaged
in internationally, in our constitution and the guiding principles of every
dominant religion or society in India.”
The petitioner has
thus urged the Court to declare such practices of usage of snares illegal and
unconstitutional, and also the actions of groups, bodies and leaders that
permit and propagate such practices must also be declared illegal,
unconstitutional, and violative of Articles 14 & 21 of the Constitution.
According to india legal It is estimated by the forest department of Kerala
that from 2012 to 2020, 24 tigers and 110 leopards have been killed by wire
snares in Kerala alone. It also has the potential to cause grievous injuries to
humans as well. Article 51 A (g) of the Constitution of India clearly
outlines the fundamental duty of every citizen to have compassion for all
living creatures. The Supreme Court of India has on various occasions clearly
held that animals have a fundamental right against the infliction of pain and
right to life and personal liberty extends to animals as well. The apex court
in a judgment titled ‘Animal Welfare Board of India v A. Nagaraja & Ors’
delivered in 2014, said expectedly that Parliament would elevate rights of
animals to that of constitutional rights, as done by many of the countries
around the world, so as to protect their dignity and honour. We will keep
