their petition
On 13 August, the Hon’ble Supreme Court had allowed the ex Union minister Arun Shourie, journalist N Ram and Bhushan to withdraw their petition challenging the constitutional validity of Section 2 sub section(1)(c) of the Contempt of Courts Act, 1971. This provision defines what can come under criminal contempt. They had alleged that it is vague, arbitrary unconstitutional & violates the freedom of speech and expression. Their petition states that the offence of 'scandalising the court' cannot be considered as contempt as under Article 19(2) the Indian Constitution permits reasonable restrictions to free speech. This petition also had an application to stay all contempt proceedings against Prashant Bhushan.
