Men and women are
not the same. Even if both have been incarcerated for the same crime, if the
woman is pregnant then the punishment is also being inflicted on her unborn
child. In normal times its bad enough, but when it comes to Coronavirus times,
should we allow any child to go through the risk, through no fault of the
child? Prison systems historically have been built keeping in mind the male
prisoners, which is why they are not equipped to cater to the needs of women
inmates. The women in the criminal justice system are among the most vulnerable
in our society in normal times. Pregnancies among incarcerated women are often
unplanned and high-risk and are compromised by a lack of prenatal care, poor
nutrition, violence, mental illness, etc. Article 21 provides us with
fundamental right to life, a life with dignity. As per the most recent data
available from the report Women in Prisons published by the Ministry
of Women and Child Development, Government of India, there are 4,19,623
persons in jails in India. Women constitute 4.3% of this figure,
numbering a total of 17,834 women. These are the official figures. Of
these, 66.8% (11,916) are under-trial prisoners. There is a lack of female
staff in prisons in the country.
Our government’s
COVID policy specifically identifies senior citizens, the co-morbid, pregnant,
lactating women as high-risk populations.
